Wer in Deutschland im Grenzgebiet wohnt, im französischen Grenzgebiet arbeitet und normalerweise täglich an seinen Wohnsitz zurückkehrt, gilt als Grenzgänger im Sinne des DBA-Frankreich. Frankreich verzichtet insoweit auf das Besteuerungsrecht.Anyone who lives in the German border area, works in the French border area and normally returns to their residence every day qualifies as a cross-border commuter within the meaning of the Germany–France DTT. France waives its taxing right accordingly.

Grenzgebiet Deutschland: Gemeinden höchstens 20 km von der Grenze entfernt (amtliche Grenzgebietsliste).German border area: municipalities no more than 20 km from the border (official border-area list).

Die Grenzgängereigenschaft bleibt erhalten, auch wenn nicht täglich zurückgekehrt wird – innerhalb dieser Grenzen: bei ganzjähriger Beschäftigung höchstens 45 schädliche Tage; bei unterjähriger Beschäftigung höchstens 20 % der Arbeitstage, nie mehr als 45.Cross-border commuter status is retained even if the employee does not return every day – within these limits: for full-year employment, no more than 45 harmful days; for part-year employment, no more than 20% of working days, never more than 45.

Was zählt als schädlicher Tag?What counts as a harmful day?

Schädlich sind mehrtägige Dienstreisen außerhalb der Grenzzone sowie ganztägige eintägige Dienstreisen außerhalb der Zone. Nicht schädlich ist, wenn sich die Arbeitszeit eines Schicht- oder Nachtdienstmitarbeiters allein wegen Anfangszeit oder Dauer über mehr als einen Kalendertag erstreckt.Harmful days include multi-day business trips outside the border zone and full-day one-day trips outside the zone. It is not harmful if a shift or night-shift worker’s hours span more than one calendar day solely because of start time or duration.

Bei mehr als 45 schädlichen Tagen entfällt die Grenzgängereigenschaft. Es greift Art. 13 Abs. 1 – Frankreich besteuert die auf französische Arbeitstage entfallenden Einkünfte.With more than 45 harmful days, commuter status no longer applies. Wer in Deutschland wohnt und vorübergehend in Frankreich tätig ist, bleibt ausschließlich in Deutschland steuerpflichtig – auch ohne Grenzgängereigenschaft –, wenn alle drei Bedingungen kumulativ erfüllt sind:Anyone resident in Germany working temporarily in France remains taxable exclusively in Germany – even without commuter status – if all three conditions are met cumulatively:

  • höchstens 183 Tage Aufenthalt in Frankreich im Steuerjahrno more than 183 days of stay in France in the tax year

Beschränkte SteuerpflichtLimited tax liability

Wer in Frankreich wohnt und in Deutschland arbeitet, ist mit den deutschen Arbeitseinkünften in Deutschland beschränkt steuerpflichtig – sofern weder die Grenzgängerregelung (Abs. 5) noch die 183-Tage-Regelung (Abs. 4) greift. Der Arbeitgeber behält Lohnsteuer ein.Anyone resident in France who works in Germany has limited tax liability in Germany on their German employment income – provided neither the commuter rule (para. 5) nor the 183-day rule (para. 4) applies. The employer withholds wage tax.

Für Vergütungen aus einem deutschen öffentlichen Dienstverhältnis besteuert Deutschland als zahlender Staat – unabhängig von Wohnort, Tätigkeitsort und Aufenthaltsdauer. Betroffen sind nicht nur Beamte, sondern auch Beschäftigte bei Gemeinden, Landkreisen, Landesbehörden oder staatlichen Krankenhäusern.For remuneration from German public-sector employment, Germany taxes as the paying state – regardless of place of residence, place of work and length of stay. This affects not only civil servants but also employees of municipalities, districts, state authorities or state hospitals.

Art. 14 verdrängt Art. 13 vollständig – die 183-Tage-Regel und die Grenzgängerregelung gelten nicht. Einkünfte aus einer in Frankreich belegenen Immobilie sind nach dem Belegenheitsprinzip Frankreich zugewiesen und dort zu versteuern. In Deutschland werden diese Einkünfte freigestellt.Income from a property located in France is allocated to France under the situs principle and taxed there. In Germany, this income is exempt.

In Deutschland gilt die Freistellungsmethode (Art. 20 Abs. 1 Buchst. a). Anders als bei Drittstaaten greift kein Progressionsvorbehalt, da Frankreich ein EU-Staat ist (§ 32b Abs. 1 S. 2 Nr. 3 EStG). Spiegelbildlich wirken sich auch Verluste aus der französischen Immobilie in Deutschland nicht aus.Germany applies the exemption method (Art. 20 (1) (a)). Unlike with third countries, no progression proviso applies, since France is an EU member state (Sec. 32b (1) sentence 2 no. 3 EStG). Conversely, losses from the French property also have no effect in Germany.

Homeoffice-Tage am deutschen Wohnsitz sind grundsätzlich keine Tage der Nichtrückkehr und regelmäßig nicht schädlich für die Grenzgängereigenschaft. Im Einzelfall sollte die konkrete Tätigkeit geprüft werden – insbesondere bei mobilen Arbeitsmodellen oder abweichenden bilateralen Verständigungsvereinbarungen, die in diesem Bereich fortlaufend weiterentwickelt werden.Home-office days at the German residence are generally not days of non-return and are usually not harmful to cross-border commuter status. The specific activity should be examined on a case-by-case basis – particularly with mobile working models or differing bilateral mutual agreements, which are continually being developed in this area.

Beschränkt Steuerpflichtige werden in Deutschland nur mit ihren inländischen Einkünften erfasst. Eine laufende Dokumentation der Arbeitstage und Dienstreisen ist daher unerlässlich – insbesondere bei Außendienst oder Projektarbeit außerhalb der Grenzzone.If more than 45 harmful working days are exceeded, cross-border commuter status no longer applies.
